is to provide funding for the next phase of connector road design. that includes allocating prop k funds to dpw which will be leading the 30% design effort for the connector road. that includes environmental review as well as starting right at negotiation. the purpose of that is to get more clarity to the schedule and make sure the connector road can move forward in parallel with the bridge replacement project. really make sure we're minimizing that construction overlap period. lastly to appropriate prop k funds to the authority to continue working on planning and project oversight as well as conducting further rounds of outreach to go into the community with the work that we're going to be doing and providing some answers to the community in the spring before we come back to the board. finally that authority piece does include that local business robust outreach strategy to make sure people are aware of and can participate in those contracting opportunities. we'll come back to the community and back to the board in the spring with remaining questions in terms of design, schedule and what the

plan for that in a minute. other work we've done worked with dpw to develop an initial design concept for that connector road to show it's a feasible concept. we've done two rounds of extensive community outreach to share our work as well as interagency coordination with dpw, mta, cal train as well as other local agency partners. diving a little more into the community outreach we've done, we have worked through two prerobust rounds of outreach. first of those were back in spring. we did an open house and other presentation to present the work we had done in the first few months after we got that appropriation and get the community's feedback. we came back to the community in november to present our draft back recommendation how we incorporated a lot of that community feedback before coming here to the board. each of those rounds included an open house with pretty good solid participation as well as notification for that each round including multilingual efforts with efforts to everyone within a half a mile. additional fliers and businesses, neighborhoods, churches, community groups t

position because you are involved through the planning process or the dbi process that came to dpw because of this problem, but it seems like an odd situation. >> you are quite correct, supervisor wiener. it is a very odd situation because the inform we were provided initially from a 2010 survey showed the historic property line. okay, and what happened is again back in 2000 a portion of that was transferred, acquired and transferred to the city as right of way and that was not identified in the map. so it appears to be some form of error that happened at that stage that really no one caught on the development team. >> thank you. >> thank you. so there is no one from planing that's here and let's open this up for public comment if there are no other questions. supervisor wiener. >> yeah, i mean i'd be a bit uncomfortable acting on this without getting more information from planning and dbi, but i'm curious to hear public comments. >> and i'll just say up front as well that it's a confusing case, especially that we don't have planning here to explain more and i realize that even dbw's a

in sunset out in irving street. i should come out here every week, the dpw folk are cleaning the streets pretty well. [laughter] >> it's great to see all of you here today. you know, earlier this year, particularly during the budget negotiations, supervisor carmen chu and i and a number of other supervisors engaged in a lot of discussions about what our neighborhood small businesses could benefit from as we saw indications of our budget recovery. and clearly we understood and have always understood the role of small businesses. and they're the backbone of the city and our office of economic development was headed by todd who is here and joaquin is helping out with the investment neighborhood strategy. we wanted to really demonstrate that, our commitment. not just by saying it, but actually doing things that would really support our small business. scott and henry and many others, benny and others who have been around us know that my favorite thing is to go to a neighborhood commercial corridor like terra val or out in the sunset noriega and have meals or breakfast or a cup of coffee and

of the transit center project. this is actually within that phase one project. we looking to meet with dpw the next main point of discussion how the environmental phase of that project will move forward. >> i just wanted to mention as far as the masonic, i think the district 11 definitely under serve as it relates to transit dollars. of course the bike rider in that particular part in district five it's very high. this has been one of those -- i think there should be more maybe conversation negotiation around some of this but certainly this has been one of the areas where bicyclist have been -- i know there have been two fatalities that i can think it. there does need to be attention given to providing a safer environment for bike pad purposes. you think that might be one of the reasons behind prioritizing this in the way that we have. it's part of obviously different picture. i wanted to make sure i put that out there. >> top two projects here, this is really unique project. it's in the middle of the park. it touches three different districts. actually in the prop double a program, we're

to not have the port own the land any more. the city ons the right-of-way. dpw gets to own the street right-of-way, but the port owns underneath. we're in the process of appraising the value of the land as open space whereas publicly owned land with the open space designation which basically means you can't build on it, a building, and getting the [speaker not understood]. and then we have a different strategies we're trying to figure out how to negotiate with the port about how to convey that money to them. but they've already shown their willingness to go through the process, do the appraisal, to take the money over time to talk about different means to receive the money. that is a separate conversation. >> there is no availability -- i know we just passed the park bond or park recreation bond. i don't know if any of the funds there were not earmarked in a way they could be used for this project. do we know? >> i'm not sure actually. i feel like we're turning over many different financing stones and even laying the [speaker not understood] to take the lead on that. and everyone kind of fe

, what agency, and you have all kinds of agencies. airport, sfmta, dpw, dbi, rec and park. it could be anything like a plumbing permit. and no one would know when the first approval is. so, the whole thing is very vague. and then you get this thing about someone says, oh, supervisor wiener says, this is improved noticing. well, in some of these instances in the legislation, if you read it very carefully as on page 2, lines 1, 12, i wasn't going to net pick in the weeds, but i have to noticing could be optional or none. * 11 because depending on the circumstances, some notices are not required and in some instances they are, so, you don't know if as it's optional or required. so this is going to turnout to be very vague. then you have this thing where you have these hearings. well, a hearing could be scheduled as on page 14 lines 7 through 8f, but it doesn't have to be held. it says it just has to be scheduled. so, the clerk can schedule a hearing, but then the next criteria is, well, how long after? well, there's no minimum so you don't even have a 14-day minimum to wait and then t

knew trees and then to do my edition. * new trees first i'd go to dpw, go get my tree permit that nobody is paying attention. that action happened. then it comes to the planning commission. is it now that they could not file a c-e-q-a appeal because they didn't file it on the tree permit? >> again, assuming the tree permit is a discretionary action, we did a cad ex for it, the cad ex would only apply to the action if that's the only action that we had in place -- [multiple voices] >> if the information that we acted on was incomplete and there was a change to the project or further development of the project that changed those conditions, go back to go here. essentially the c-e-q-a clearance is on what we know and what we address. if we didn't address an aspect of the project because it wasn't put before us, then that becomes a new discretionary action subject to new environmental review subject to new appeals. i guess, i would imagine people would give the whole project -- i do think we're shortening the window. i guess the question is, then, what is the process currently? l

discussions with the department, specifically the department of dpw, it would be, they would agree to us rejecting this and sending it back and asking to come back with a street vacation rather than a major encroachment. so that's the course of action i would like to propose that we take today. >> so that sounds to me like it's a motion to reject this resolution. >> yes. >> amend the resolution as a rejection. >> amend the resolution as a rejection. >> mr. gibner indicated that the resolution before us to --. >> either up or down. >> is to approve the encroachment. i think it would require a motion to amend the resolution to reject and then to forward that resolution to the board. >> correct. >> so there's a motion -- there is an amendment to the table to reject. are there any objections? so -- and then on the motion itself as amended to reject, are there any objections? >> that would be to forward the amended resolution to the board with a recommendation to adopt it. >> yes. so without objection. thank you. thank you, mr. gibner. miss miller, could you please call item no. 2? >> it
